How SwingDesire collects, uses, protects and shares personal information.

Who is responsible for your information?

SwingDesire Ltd operates SwingDesire and is the data controller responsible for deciding how personal information is used.

SwingDesire Ltd is registered in England and Wales under company number 17345958.

Information we collect

Depending on how you use the service, we may collect:

  • Account details such as your name, username, email address and encrypted password information.
  • Profile information such as age, relationship type, gender, sexual orientation, interests, biography and preferences.
  • Photographs, videos, posts, comments and other content you upload.
  • Messages, reports, support requests and communications with us.
  • Approximate or precise location information where you choose to enable a location-based feature.
  • Verification information used to confirm age, identity or profile authenticity.
  • Event booking, attendance and ticket-category information.
  • Payment and subscription information. Full payment-card details are processed by our payment provider and are not stored directly by SwingDesire.
  • Technical information such as IP address, device type, browser, login activity, security records and diagnostic logs.
  • Cookie, consent and analytics information as described in our Cookie Policy.

Sensitive profile information

Profile information about sexual orientation, sex life and certain relationship preferences may be treated as special-category personal data under UK data-protection law.

Where we process this information to provide profile, discovery, messaging and community features, we rely on your explicit consent in addition to an appropriate lawful basis under Article 6 of the UK GDPR.

You may withdraw consent by removing optional profile information, changing relevant settings, closing your account or contacting us. Withdrawal does not make earlier lawful processing unlawful, but it may mean that some features can no longer be provided.

Age and identity verification

SwingDesire is strictly for adults aged 18 and over. We may ask members to complete age, identity, face or profile-authenticity checks.

A verification check may involve an identification document, date of birth, photograph, selfie, facial comparison result or confirmation supplied by a specialist verification provider.

Verification images are used only for verification, safety and fraud-prevention purposes. They are not displayed publicly or used as member profile photographs unless the member separately uploads a photograph for that purpose.

Where biometric recognition or technical facial comparison is used to verify identity, the resulting biometric information may be special-category data. We will identify an appropriate lawful basis and special-category condition before using such processing.

Verification material will be deleted when it is no longer required for the check, unless temporary retention is reasonably necessary for manual review, fraud prevention, a dispute or a legal obligation. We may retain a limited record showing that verification was completed, failed, expired or required review.

How we use information

  • To create, manage and secure your account.
  • To display your profile according to your privacy settings.
  • To provide messaging, groups, discovery, events and community features.
  • To provide location-based features where you choose to enable them.
  • To verify accounts and protect members from fraud, impersonation and misuse.
  • To moderate content, investigate reports and enforce our rules.
  • To process subscriptions, payments, cancellations and event bookings.
  • To provide support and respond to enquiries.
  • To maintain security, prevent abuse and diagnose technical problems.
  • To improve the operation, reliability and usability of the service.
  • To comply with legal obligations and lawful authority requests.

Our legal reasons for using information

We use personal information only where an appropriate legal basis applies.

  • Contract: where processing is necessary to create and operate your account, provide membership features, process subscriptions or manage bookings.
  • Consent: where you make an optional choice, enable a location feature, receive non-essential marketing or provide information that requires consent.
  • Legitimate interests: where reasonably necessary to operate, secure and improve the service, prevent fraud, investigate misuse, moderate content and protect members. We assess these interests against your rights and expectations.
  • Legal obligation: where information must be processed to comply with tax, accounting, consumer-protection, safeguarding, court or regulatory requirements.
  • Vital interests: in exceptional circumstances where processing is necessary to protect someone’s life.

Where special-category information is processed, we also rely on an applicable Article 9 condition. For optional profile information concerning sexual orientation or sex life, this will normally be your explicit consent.

Photo moderation and automated checks

Photographs and other content may be checked using automated moderation tools designed to identify potentially prohibited, unsafe or inappropriate material.

Automated systems may flag content or verification results for manual review. A flag does not necessarily mean that content has breached our rules.

Where a decision could significantly affect access to the service, we aim to provide appropriate human review and a way to challenge the decision through our Complaints, Reports and Appeals process.

Who information may be shared with

Information may be shared with trusted providers where reasonably necessary to operate the service, including providers of:

  • website hosting, private media storage and content delivery;
  • email delivery and customer support;
  • payments and subscription processing;
  • age, identity and profile verification;
  • photo moderation, fraud prevention and platform security;
  • analytics, performance monitoring and technical diagnostics;
  • event booking and venue administration.

We currently use services including Stripe for payment processing and Amazon Web Services for aspects of hosting, private media storage and automated image moderation.

Information may also be disclosed to police, regulators, courts, safeguarding bodies, insurers or professional advisers where legally required or reasonably necessary to address fraud, abuse, safety concerns or legal claims.

We do not sell personal information to advertisers and do not allow members to purchase another member’s personal information.

Event partners and venues

Where you book or attend an event, limited information may be shared with the relevant event organiser, venue or admission team where necessary to manage tickets, confirm eligibility, operate guest lists, provide accessibility support or maintain safety.

We will not provide event partners with more information than is reasonably necessary for those purposes.

How long information is kept

We keep personal information only for as long as it is reasonably necessary for the purpose for which it was collected.

  • Active account information: normally retained while your account remains open.
  • Deleted accounts: account information will normally be deleted or anonymised following closure, subject to backups, safety records and legal retention requirements.
  • Verification information: retained only for the time needed to complete or review the check. A limited verification-status record may be retained while the account exists and for a reasonable period afterwards for safety and fraud prevention.
  • Payment and accounting records: may be retained for up to six years where required for accounting, taxation, disputes or legal compliance.
  • Reports, moderation and safety records: may be retained after account closure where reasonably necessary to investigate complaints, prevent repeat abuse, defend legal claims or protect members.
  • Technical and security logs: retained for a limited period based on security, diagnostic and fraud-prevention needs.
  • Backups: deleted information may remain temporarily in encrypted backups until those backups are overwritten through the normal backup cycle.

International services

Some suppliers may process personal information outside the United Kingdom.

Where a restricted international transfer takes place, we will use an appropriate legal safeguard where required. This may include a UK adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses or another lawful transfer mechanism.

Your rights

Depending on the circumstances and the lawful basis used, you may have the right to:

  • request access to your personal information;
  • request correction of inaccurate or incomplete information;
  • request deletion of information;
  • request restriction of processing;
  • object to processing based on legitimate interests;
  • receive certain information in a portable format;
  • withdraw consent at any time;
  • ask for human review of an applicable automated decision;
  • complain to the Information Commissioner’s Office.

You can also complain to the UK Information Commissioner’s Office. We would appreciate the opportunity to investigate and address your concern first.

Children and underage accounts

SwingDesire is not intended for anyone under 18.

Where we reasonably suspect that an account belongs to or involves someone under 18, we may restrict the account while the matter is investigated. Information may be preserved or disclosed where legally required or reasonably necessary to protect a child, investigate misuse or prevent repeat access.

Security

We use technical and organisational safeguards designed to protect personal information, including access restrictions, private media controls, encryption where appropriate, moderation, security monitoring and account-protection measures.

No online service can guarantee absolute security. Members must keep passwords and verification codes confidential and should contact us promptly if they believe their account has been compromised.

Changes to this policy

We may update this Privacy Policy when the service, our providers or legal requirements change. The latest version and its effective date will be published on this page.

Where a change materially affects how we use personal information, we may provide an additional notice through the website, account area or email.
