Using SwingDesire

Terms of Service

The rules and conditions that apply when you create an account or use SwingDesire.

Who we are

These Terms are between you and SwingDesire Ltd, a company registered in England and Wales under company number 17345958.

SwingDesire Ltd operates the SwingDesire website, member community, related features and SwingDesire-operated events.

Agreement to these Terms

By creating an account, purchasing a membership, booking an event or otherwise using SwingDesire, you agree to these Terms.

You must also follow our Community Guidelines, Privacy Policy, Photo and Content Policy, Age and Verification Policy and any additional rules clearly shown for a particular feature, membership or event.

If you do not agree to these Terms, you must not create an account or use the service.

Adults only

SwingDesire is strictly for adults aged 18 and over.

  • You must be at least 18 years old to create or use an account.
  • Every person represented by an account must be at least 18 years old.
  • Every identifiable person appearing in uploaded content must be an adult and must have agreed to that content being shared.
  • You may be required to complete age or identity verification.

We may restrict an account immediately where we reasonably suspect that it belongs to, represents or contains content involving someone under 18.

Eligibility

To use SwingDesire, you must:

  • have legal capacity to enter into a binding agreement;
  • provide accurate and current information;
  • use the service only for lawful personal purposes;
  • not be prohibited from using the service under applicable law;
  • not be subject to a permanent SwingDesire ban unless we have given written permission for a new account.

We may refuse registration where this is reasonably necessary to protect members, prevent fraud, enforce a previous restriction or comply with law.

Your account

You are responsible for keeping your account information accurate and your login credentials secure.

You must not:

  • share your login details with an unauthorised person;
  • allow another person to operate your account without our permission;
  • create deceptive, duplicate or impersonation accounts;
  • misrepresent your age, identity, gender, relationship type or verification status;
  • attempt to obtain access to another member’s account.

Tell us promptly if you believe your account has been compromised. You remain responsible for activity carried out through your account until you notify us, except where the activity resulted from something for which we are legally responsible.

Couple accounts

A couple account may only represent adults who know about and agree to the creation and use of the account.

Each partner must provide accurate information and may be required to complete separate verification checks. One partner must not upload private information or intimate content concerning the other without their permission.

If consent to the couple account is withdrawn, the account may be restricted while ownership, content and privacy issues are reviewed.

Verification

We may require age, identity, face or profile-authenticity checks before granting or continuing access to some or all features.

A verification badge or completed check means that specified information was checked at a particular time. It does not guarantee a member’s character, intentions, relationship status, compatibility, conduct or future behaviour.

You must not submit false documents, use another person’s identity, manipulate verification material or attempt to bypass a verification requirement.

Where a check cannot be completed automatically, we may conduct a manual review or request further information.

Member profiles and interactions

SwingDesire provides tools that allow adults to create profiles, communicate and discover people, groups, events and communities.

We do not introduce members as professional advisers, agents, escorts, employees or representatives of SwingDesire. You are responsible for deciding whether, when and how to interact with another member.

Profiles, messages, photographs, verification and moderation can reduce certain risks but cannot eliminate them. You should follow the guidance in our Safety Centre and use appropriate care before sharing information or meeting someone in person.

Consent and boundaries

All interaction must respect personal boundaries and freely given consent.

  • A profile, message, photograph, membership type or previous interaction does not imply consent.
  • Consent must be informed, specific, voluntary and ongoing.
  • Consent may be withdrawn at any time.
  • You must stop an interaction when consent is refused or withdrawn.
  • You must not send explicit content unless the recipient has clearly agreed to receive it.

Harassment, coercion, pressure, stalking, threats, blackmail and non-consensual intimate content are prohibited.

Acceptable use

You must use SwingDesire in accordance with these Terms and our Community Guidelines.

You must not:

  • use the service for prostitution, escorting, trafficking, exploitation or the sale of sexual services;
  • sell or solicit explicit content, private performances or pay-per-view adult material;
  • harass, threaten, stalk, intimidate or repeatedly contact someone who has asked you to stop;
  • share another person’s identity, location, messages, photographs or private information without permission;
  • upload intimate content without the informed consent of every adult shown;
  • publish content involving or appearing to involve a person under 18;
  • impersonate another person or use stolen, misleading or manipulated photographs deceptively;
  • commit fraud, operate a scam, request money deceptively or promote unlawful activity;
  • send spam, malware, malicious links or unauthorised commercial advertising;
  • scrape, harvest, copy or systematically collect member information;
  • circumvent privacy controls, blocks, suspensions, payment controls or security measures;
  • interfere with the operation, integrity or availability of the service;
  • use automated systems, bots or scripts without our written permission.

Member content

You retain ownership of photographs, videos, text and other content that you upload.

By uploading content, you grant SwingDesire Ltd a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display and transmit that content only as reasonably necessary to:

  • provide the service according to your chosen visibility settings;
  • create technical copies, thumbnails and compatible file formats;
  • operate backups and content-delivery systems;
  • moderate content, investigate reports and enforce these Terms;
  • comply with legal obligations.

This licence does not give us permission to use private member content in public advertising without separate permission.

The licence ends when the content is deleted from our active systems, except where temporary copies remain in backups or retention is reasonably necessary for reports, safety, legal compliance or legal claims.

Your responsibility for content

You must have all rights, permissions and consents needed for anything you upload or share.

You must not upload content that:

  • infringes copyright, privacy, data-protection or other legal rights;
  • contains personal information belonging to someone who has not agreed to its disclosure;
  • is unlawful, fraudulent, defamatory, threatening or malicious;
  • contains viruses, harmful code or deceptive links;
  • breaches our Photo and Content Policy.

You are responsible for claims resulting from content you unlawfully upload. Nothing in this section requires a consumer to compensate us for losses caused by our own breach, negligence or unlawful conduct.

Privacy controls

Visibility controls help you choose who can view certain profile information or content. You are responsible for selecting settings that are suitable for you.

No technical control can prevent an authorised viewer from taking a screenshot, making a recording or otherwise copying information. Such copying may breach these Terms, but we cannot guarantee that it will never occur.

Only upload information and content that you are comfortable sharing with the audience selected.

Moderation and automated checks

We may use human review and automated tools to identify content or activity that may breach our rules, threaten safety or require further investigation.

We are not required to pre-screen every profile, message, photograph, event, group or upload. The absence of action does not mean that we have approved or endorsed content or conduct.

Automated tools may place content into review, prevent publication or flag an account for human assessment. Where appropriate, members may challenge a moderation decision through our Complaints, Reports and Appeals process.

Reports and investigations

You may report members, messages, content or activity through the available reporting tools or our Contact page.

When investigating a report, we may review relevant profiles, content, messages, login information, reports and account activity where reasonably necessary and permitted by law.

We do not normally disclose confidential details about another member or every step taken during an investigation. We may confirm that a report has been reviewed and provide appropriate information about the outcome.

Knowingly submitting false, malicious or abusive reports may itself breach these Terms.

Warnings, restrictions and account removal

Where we reasonably believe that these Terms, our policies or the law have been breached, we may:

  • remove or limit content;
  • request verification or additional information;
  • issue guidance or a warning;
  • limit messaging, posting, discovery or other features;
  • temporarily suspend an account;
  • cancel membership access;
  • permanently close an account;
  • preserve or disclose information where legally permitted or required.

The action taken will depend on factors including seriousness, evidence, risk, previous conduct and legal obligations.

We may act without advance notice where reasonably necessary to prevent harm, secure the service, investigate suspected fraud, protect another person or comply with law.

Appeals

You may ask us to review certain warnings, content removals, suspensions or account closures by following our Complaints, Reports and Appeals process.

An appeal should explain why you believe the decision was incorrect and include any relevant evidence. Submitting an appeal does not automatically restore content, features or account access while the review takes place.

Free and paid membership

Some features may be available without charge and others may require a paid membership.

The price, billing interval, included features, trial terms and any minimum commitment will be clearly shown before you purchase.

Paid memberships may renew automatically where this is clearly disclosed during checkout. By purchasing an automatically renewing membership, you authorise the payment provider to collect the stated recurring charge until the membership is cancelled or otherwise ends.

Free features, trial features and membership benefits may differ. We may introduce, remove or change features, but we will not remove a material paid benefit during a current paid period without an appropriate reason and, where required, notice or another suitable remedy.

Payments

Payments are processed by our payment provider. We do not normally receive or store your complete payment-card details.

You must provide accurate billing information and have permission to use the selected payment method.

If a payment fails, is reversed or is disputed, we may suspend paid features while the issue is resolved. We will not restrict statutory rights or pursue charges that are not properly due.

Taxes and other mandatory charges will be included or clearly identified where applicable.

Trials and promotional offers

A trial or promotional offer may be subject to additional conditions shown when you register.

Unless stated otherwise:

  • an offer may be limited to one per person, household, account or payment method;
  • we may refuse or withdraw an offer where it is being abused or obtained deceptively;
  • if a trial converts to a paid subscription, the price and conversion date will be displayed before the trial begins;
  • you may cancel before the stated conversion date to prevent the first recurring charge.

Cancelling a membership

You may cancel an automatically renewing membership through the available account controls or by contacting us.

Unless a statutory cancellation right or refund applies, cancellation normally stops future renewal and paid access continues until the end of the period already paid for.

Deleting an app, closing a browser window or ceasing to use the service does not by itself cancel a paid membership. You must use the stated cancellation method or ask us to cancel it.

Nothing in these Terms limits any cancellation or cooling-off right provided by applicable consumer law.

Cooling-off rights and early access

Consumers may have a legal right to cancel certain online purchases during a statutory cooling-off period.

Where you ask for a paid service to begin during a cooling-off period, you may be required to make an express request. If you then cancel, the law may allow us to charge a proportionate amount for services supplied before cancellation.

Where digital content is supplied immediately, you may be asked to expressly consent to immediate supply and acknowledge any effect this has on a cancellation right.

Details applying to a particular purchase will be shown during checkout or in the confirmation information provided to you.

Refunds

Refunds are provided where required by law and in accordance with any refund terms clearly shown before purchase.

Except where the law provides otherwise, payments are not automatically refundable merely because:

  • you did not use the service;
  • you forgot to cancel before a renewal;
  • another member did not respond or an interaction did not meet your expectations;
  • you were restricted for breaching these Terms.

We will consider the circumstances fairly, including service failures, duplicate charges, legal cancellation rights and any error for which we are responsible.

Price changes

We may change membership prices from time to time.

A price change will not normally affect a paid period that has already begun. Where an automatically renewing price is changing, we will provide reasonable advance notice and explain when the new price will apply and how to cancel.

Events and tickets

Bookings for SwingDesire-operated events are also governed by our Events and Ticket Terms and any event-specific information shown before purchase.

Some events displayed on the service may be organised independently by third-party venues or organisers. Where this is made clear, the third party is responsible for operating the event and its own booking terms may apply.

A member profile, verification status or membership does not automatically guarantee admission to an event. Admission may remain subject to ticket category, identification, venue rules, capacity, conduct and safety requirements.

Third-party services and links

The service may link to or integrate with payment providers, venues, verification providers, mapping services, external websites and other third-party services.

Third parties operate under their own terms and privacy information. We are not responsible for an independent third party’s service, content or conduct merely because it is linked from SwingDesire.

This does not exclude responsibility where the third party acts on our behalf and the law makes us responsible for its actions.

Intellectual property

The SwingDesire name, logo, website design, software, graphics and original materials are owned by or licensed to SwingDesire Ltd.

We grant you a personal, limited, revocable, non-exclusive and non-transferable right to use the service in accordance with these Terms.

You must not copy, reproduce, sell, reverse engineer, distribute or commercially exploit our software, branding or original materials except where permitted by law or with our written permission.

Service availability

We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability.

Access may occasionally be limited because of maintenance, security incidents, updates, provider failures, legal requirements or circumstances outside our reasonable control.

We will take reasonable steps to restore material service interruptions and communicate significant planned changes where appropriate.

Changes to the service

We may update, improve, replace or discontinue features where reasonably necessary for security, legal compliance, technical development, member safety or operation of the service.

Where a change materially disadvantages an active paid membership, we will provide reasonable notice where practicable and any remedy required by consumer law.

Your statutory rights

Nothing in these Terms removes or limits rights that consumers have under applicable law.

Services and digital content must meet applicable legal standards. Remedies may be available where paid services are not provided with reasonable care and skill, or digital content is faulty or does not match its description.

Our responsibility

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of mandatory consumer rights;
  • any other liability that cannot legally be excluded.

We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for loss or damage that:

  • was not reasonably foreseeable when the contract was made;
  • was caused by inaccurate information, unlawful content or misconduct supplied by a member;
  • resulted from an independent venue, organiser or third-party provider outside our reasonable control;
  • was caused by your failure to follow reasonable safety or security instructions;
  • relates to business use, loss of profit or commercial activity where you use the consumer service for an unauthorised business purpose.

We do not guarantee that another member is suitable, compatible, trustworthy or safe, or that any meeting, relationship or event will meet your expectations.

Events, meetings and member conduct

Unless we expressly state otherwise, an interaction or meeting arranged between members is private and is not organised, supervised or controlled by SwingDesire Ltd.

Members are responsible for their own decisions, transport, accommodation, alcohol consumption, sexual-health precautions, personal boundaries and compliance with law.

This does not affect any responsibility we may have for an event that we directly organise or for a failure by us to comply with a legal duty.

Closing your account

You may stop using the service and request account closure at any time.

Closing an account does not automatically reverse completed payments, cancel separate event bookings or remove information that we must retain for legal, accounting, safety, fraud-prevention or dispute purposes.

Before closing a couple account, we may need to consider requests from each represented partner concerning their personal information and content.

What happens when access ends

When your account ends, your right to use member-only features stops.

Terms concerning member content, intellectual property, payments already due, investigations, legal claims, liability and governing law may continue where reasonably necessary.

Changes to these Terms

We may update these Terms to reflect changes to the service, law, safety requirements, providers or business operations.

The latest version and updated date will be published on this page. Where a change materially affects existing members, we will provide reasonable additional notice through the website, account area or email.

If you do not agree to a material change, you may stop using the service and cancel any renewing membership before the change takes effect.

Transfer of these Terms

We may transfer our rights and obligations under these Terms to another organisation as part of a restructuring, sale or transfer of the service, provided this does not reduce your legal rights.

You may not transfer your account or rights under these Terms to another person without our written permission.

If part of these Terms is invalid

If a court or relevant authority finds that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.

No waiver

If we do not immediately enforce a provision of these Terms, that does not prevent us from enforcing it later. Any action we take must remain consistent with applicable law and consumer rights.

Nothing in these Terms prevents you from seeking advice from Citizens Advice, Trading Standards or another appropriate consumer-protection body.

Governing law and courts

These Terms are governed by the laws of England and Wales.

If you are a consumer living in another part of the United Kingdom, you retain any mandatory rights that apply where you live and may be entitled to bring proceedings in your local courts.

We encourage members to contact us first so that we have an opportunity to resolve a concern, but this does not limit the right to use the courts or another remedy available under law.
